1. Introduction

Welcome to Second Stride, a second-hand equestrian equipment marketplace operated by [COMPANY NAME], registered in Belgium under company number (KBO/BCE) [KBO NUMBER], VAT number [VAT NUMBER], with registered office at [STREET, POSTAL CODE, CITY, BELGIUM] (hereinafter "Second Stride", "we", "us" or "our").

These Terms and Conditions ("Terms") govern your access to and use of the Second Stride platform, including our website, mobile interfaces, APIs and any related services (collectively, the "Platform").

By creating an account or using the Platform, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Platform Description — Marketplace Facilitator

Second Stride is an online marketplace facilitator. We provide a technology platform that enables private individuals and businesses ("Sellers") to list, offer and sell second-hand equestrian equipment to buyers ("Buyers"). We are not a party to any transaction between Buyers and Sellers. We do not own, inspect, warrant or guarantee any listed item.

Second Stride acts solely as an intermediary. The contract for the sale of any item is formed directly between the Buyer and the Seller.

3. Eligibility

To use the Platform you must:

  • Be at least 18 years of age;
  • Have the legal capacity to enter into binding contracts;
  • Provide accurate, current and complete information during registration;
  • Not have been previously suspended or banned from the Platform.

4. Account Registration

4.1 You must create an account to list items or make purchases. You are responsible for maintaining the confidentiality of your login credentials.

4.2 You must provide accurate and up-to-date information, including your real name and a valid email address.

4.3 You are responsible for all activity that occurs under your account. Notify us immediately at [EMAIL] if you suspect unauthorised access.

4.4 You may not transfer your account to any other person or use another person's account.

4.5 We reserve the right to suspend or terminate accounts that we reasonably believe are being used fraudulently, in violation of these Terms, or in a manner harmful to other users or the Platform.

5. Seller Obligations

5.1 Accuracy: Sellers must provide accurate, complete and non-misleading descriptions of all listed items, including condition, size, brand, defects and any relevant history.

5.2 Ownership: By listing an item, you represent and warrant that you are the lawful owner or have the right to sell the item, and that it is free from any encumbrances or third-party claims.

5.3 Prohibited items: The following items are strictly prohibited:

  • Stolen goods;
  • Counterfeit or replica branded goods;
  • Live animals (the Platform is for equipment only);
  • Weapons, ammunition or dangerous substances;
  • Items that do not comply with applicable EU or Belgian product safety standards;
  • Any other item prohibited by applicable law.

5.4 Prices must be stated in euros (EUR) inclusive of any applicable taxes.

5.5 Upon sale, Sellers must ship the item promptly, package it securely and generate the shipping label through the Platform.

5.6 Payment via Platform only: All payments must be processed through the Platform. Attempting to redirect Buyers to pay outside the Platform is a serious violation and may result in immediate account suspension.

5.7 Stripe Connect: By completing Seller onboarding, you agree to Stripe's Connected Account Agreement and Terms of Service.

6. Buyer Obligations

6.1 Buyers must pay for items in full at the time of purchase using the payment methods provided.

6.2 Buyers must provide accurate shipping addresses. We are not liable for non-delivery due to incorrect addresses.

6.3 Buyers must inspect received items promptly and raise any disputes within the applicable timeframe.

6.4 Buyers must not abuse the dispute or refund system. Fraudulent disputes will result in account suspension and may be reported to relevant authorities.

7. Safety Warning — Protective Equipment

⚠️ Important notice regarding helmets and body protectors: Second-hand protective equestrian equipment (riding helmets, body protectors, air vests) may have sustained hidden structural damage that is not visible to the naked eye. Such damage significantly reduces protective capability. We strongly recommend that Buyers:

  • Only purchase protective equipment from known, trusted sources with a verified history;
  • Never purchase a helmet or body protector that has sustained an impact, regardless of appearance;
  • Verify that all safety certifications (e.g. EN 1384, PAS 015, BETA) are current and appropriate.

Second Stride accepts no liability for injuries sustained as a result of the use of second-hand protective equipment purchased through the Platform.

8. Fees and Charges

8.1 Buyer service fee: A platform service fee is added to each transaction, displayed at checkout before confirmation.

8.2 Seller service fee: A percentage of the final sale price is deducted from the Seller's payout. The current rate is displayed in account settings.

8.3 Shipping costs: Calculated at checkout based on weight, dimensions and destination.

8.4 All fees are inclusive of Belgian VAT at the applicable rate (currently 21%).

8.5 We reserve the right to modify our fee structure. Changes will be communicated at least 30 days before taking effect for existing users.

9. Payments and Payouts

9.1 Payments are processed by Stripe (Stripe Payments Europe, Ltd., Dublin, Ireland). By making a purchase, you also agree to Stripe's Terms of Service.

9.2 Payout hold period: Seller payouts are held for a period following confirmed delivery to protect Buyers. The current hold period is displayed in Platform settings.

9.3 Dispute hold: If a dispute is opened on an order, any pending payout is automatically frozen until the dispute is resolved.

10. Shipping

10.1 Shipping labels are generated through Sendcloud. By using the shipping service, you agree to the applicable carrier's terms and conditions.

10.2 Risk of loss passes to the Buyer upon handover to the carrier.

10.3 For shipments outside the European Union (e.g. United Kingdom, Switzerland, Norway), the Buyer may be subject to customs duties and import taxes. These are the sole responsibility of the Buyer.

10.4 Estimated delivery times are provided by carriers and are not guaranteed.

11. Returns, Cancellations and Right of Withdrawal

11.1 Private Sellers (C2C): Where the Seller is a private individual, the EU statutory 14-day right of withdrawal under Directive 2011/83/EU does not apply. Returns are subject to the Seller's individual policy stated in the listing.

11.2 Business Sellers (B2C): Where the Seller is a registered business, Buyers have a statutory 14-day right of withdrawal from the date of receipt of the item, in accordance with Belgian consumer protection law (Book VI of the Code of Economic Law). Return shipping costs in such cases are borne by the Buyer unless the item is faulty.

11.3 Item not as described: If an item is significantly not as described, the Buyer may open a dispute. Second Stride may, at its discretion, issue a full or partial refund.

12. Disputes

12.1 Disputes must be opened through the Platform's dispute centre within 14 days of confirmed delivery (or within 14 days of expected delivery where the item was not received).

12.2 Both parties must communicate in good faith to attempt resolution. Second Stride may act as mediator and issue a final, binding decision within the Platform.

12.3 For disputes that cannot be resolved through the Platform, you may refer the matter to the Belgian Consumer Mediation Service (Service de Médiation pour le Consommateur / Consumentenombudsdienst) or use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Prohibited Conduct

You must not:

  • Use the Platform for any unlawful purpose;
  • Harass, threaten or abuse other users;
  • Attempt to circumvent Platform fees by completing transactions off-platform;
  • Create multiple accounts to evade bans or restrictions;
  • Use automated tools (bots, scrapers) without our written consent;
  • Post false, misleading or fraudulent listings;
  • Impersonate any person or entity;
  • Attempt to gain unauthorised access to our systems.

14. Intellectual Property

14.1 The Platform, including its design, code, trademarks and content created by Second Stride, is the intellectual property of [COMPANY NAME] and is protected by Belgian and EU intellectual property law.

14.2 By uploading content (listings, photos, descriptions), you grant Second Stride a non-exclusive, worldwide, royalty-free licence to use, display and distribute that content for the purposes of operating the Platform.

14.3 You warrant that any content you upload does not infringe third-party intellectual property rights.

15. Limitation of Liability

15.1 Second Stride is a marketplace facilitator and is not the seller of any item. We do not inspect, verify, endorse or warrant the quality, safety, legality or accuracy of any listing.

15.2 To the fullest extent permitted by applicable law, Second Stride shall not be liable for:

  • Any direct, indirect, incidental, consequential or punitive damages arising from your use of the Platform;
  • The acts or omissions of any Buyer or Seller;
  • The quality, safety or fitness for purpose of any item;
  • Loss of data, revenue or profits;
  • Service interruptions or technical errors.

15.3 Our total aggregate liability shall not exceed the total fees paid by or to you in the 12 months preceding the event giving rise to the claim.

15.4 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or any other liability that cannot be excluded under Belgian law.

16. Tax Reporting — DAC7

In accordance with EU Council Directive 2021/514 ("DAC7"), Second Stride is required to collect and report certain Seller information to the Belgian tax authority (SPF Finances / FOD Financiën) for Sellers who complete more than 30 transactions or receive gross revenues exceeding EUR 2,000 in a calendar year.

We may collect and verify: full legal name, primary address, date of birth or company registration number, tax identification number, bank account details (IBAN), and total gross revenues. This information will be reported by 31 January of the following year. By using the Platform as a Seller, you consent to this obligation.

17. Privacy and Cookies

Your use of the Platform is governed by our Privacy Policy, incorporated into these Terms by reference.

18. Platform Availability

We do not guarantee Platform availability at all times. We may suspend access for maintenance or circumstances beyond our control and will endeavour to provide advance notice.

19. Amendments

We reserve the right to amend these Terms at any time. Material changes will be notified at least 30 days before taking effect. Continued use constitutes acceptance of the amended Terms.

20. Governing Law and Jurisdiction

These Terms are governed by Belgian law. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of [CITY], Belgium, without prejudice to your rights as a consumer under applicable Belgian and EU law.
